    7. A survey was performed on this product and it was determined that upon delivery to consignee that the reefer unit of the delivery truck was not functioning properly. Upon delivery - "The shipment was stripped on the same day and temperatures taken by the consignee at the rear, middle, front pallets in the top, middle and bottom cases ranged between 20 F and 41 F." Upon inspection of this lot, a number of cartons and pallets were randomly picked, opened and examined. "The 7" garlic bread sticks, packed in plastic bags were found to be frozen, however the butter-like topping on the breadsticks had evidence of melting forming puddles that had re-frozen. There were ice crystals on the inside and outside of the bags as well."

      • The approved high bidder must make payment for this lot by end of day of  November 3, 2010.
      • The approved high bidder must pick up this lot on Friday, November 5, 2010 or Tuesday, November 9, 2010.
      • The approved high bidder must comply with ALL the terms and conditions of this sale or product will not be released.
      • Buyer must sign Seller's Hold Harmless Form and Release and Indemnification Form.

      Seller Terms

      • Salvex and the seller have the right to reject any and all offers.
      • This product is sold AS IS, WHERE IS.
      • Buyer is responsible for all taxes, duties, loading and freight charges.
      • Seller does not offer any warranties or manufacturer warranties.
      • Upon receipt of cleared funds, Seller will provide the Buyer a Release Order for item pick up. Title transfers from Seller to Buyer upon issuance of the Release Order.
      • It is Buyer's responsibility to verify quantities and condition at the time of pick up. Once the product has been removed from Seller's location, there will be no adjustments based on quantity or condition.
